The petitioner seeks bail in Saharsa Sadar P.S. Case No. 744 of 2017 registered for the offence under Secctions-302/34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Saharsa.
According to FIR, the petitioner and others gave dagger blow to Rohan Singh who subsequently died as a result thereof. The postmortem report is consistent with the prosecution allegation. The petitioner is in custody since 17-07-2017. Considering the nature of allegation, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is rejected for the present.
However, the petitioner may renew his prayer for bail, if
