The petitioner apprehends his arrest in Hajipur Sadar P.S. Case No.319 of 2017 registered under Sections 188, 447, 379 of the Indian Penal Code and 49 of the Bihar Minor Mineral Concession(BMMC) Rule, 1972.
The learned counsel for the petitioner submits that sand was not recovered from the possession of the petitioner. Three persons were apprehended in the spot and they have said to have disclosed that the petitioners had collected the sand and bestowed there. It is submitted that similarly situated co-accused Pappu Sahni has already been granted anticipatory bail. Considering the facts aforesaid and the nature of

No.63463 of 2017 (2) dt.11-01-2018 allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No.319 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
