Petitioner is apprehending his arrest in connection with Belaganj P.S.Case No.349 of 2018 (G.R.No.7970 of 2018) , registered for offences punishable under Sections 341, 323, 379, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution case is that the petitioner fired on the informant causing injury to him and there is allegation against the co-accused of firing also.
Submission of the learned counsel for the petitioner is that FIR itself shows that injury to the informant has not been attributed by the petitioner and petitioner has no criminal antecedent . Other accused person have been granted privilege
Patna High Court CR. MISC. No.60659 of 2019(2) dt.24-09-2019 2/2 of anticipatory bail, vide order dated 17.4.2019 passed in Cr. Misc. No.23949 of 2019.
Heard learned A.P.P. and the learned counsel for the O.P.no.2 who has appeared suo motu, and opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM XI, Gaya in connection with Belganj P.S.Case No.349 of 2018 dated 1.12.2018 (G.R.No.7970 of 2018) subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
