Informant, victim a minor had alleged against the petitioner to have rape her after taking her to a building of a school.

It has been submitted on behalf of the petitioner that there happens to be delay in institution of the case. Furthermore, it has also been submitted that during course of statement under Section 164 CrPC, victim gave a twist by way of putting presence of two more persons who participated during the aforesaid even and that being so, the statement of the victim happens to be unreliable whereupon, petitioner who is under custody since 17.10.2017, be allowed bail.

Patna High Court Cr.Misc. No.1232 of 2018 (2) dt.11-01-2018 On the other hand, learned APP opposed the prayer for bail.

In both the statements, petitioner has been identified to be the rapist. Prayer for bail is rejected.
