JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 This is an application for grant of anticipatory bail in connection with Mahua P. S. Case No. 429 of 2019, disclosing offences under Sections 414, 120B of IPC and Sections 30(a), 32 (ii), 38 (ii), 41(i) of the Bihar Prohibition and Excise Act, 2018.

There is recovery of 5944 liters of foreign liquor from a truck and one Bikash Kumar @ Bala Ji was arrested, who disclosed the name of the petitioner and other accused persons, as other accomplish.

Submission of the learned counsel for the petitioner is that prior to lodging of the case, petitioner has lodged a complaint case against Bikash Kumar @ Bala Ji, due to that he has falsely been implicated in this case and one more case at the instance of Bikash Kumar @ Bala Ji. Apart from confession,

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur, in connection with Mahua P. S. Case No. 429 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to cooperate the I.O. during the course of investigation and appear as and when required.
