The petitioner seeks regular bail in connection with Akorhigola P.S. Case No. 09 of 2016, registered for the offence punishable under Section 395 of the Indian Penal Code.

The allegation is regarding the accused persons having entered the house of the informant and having committed theft of ornaments, silver chain and various other articles as also having assaulted the informant and his family members.

The learned counsel for the petitioner submits that the petitioner is a non F.I.R. named accused person and his name has transpired upon the confessional statement made by

It is further submitted that the co-accused person, namely, Sonu Kumar has already been granted bail by this Court by an order dated 19.11.2016 passed in Criminal Miscellaneous No. 38594 of 2016. It is further submitted that neither any recovery has been made from the petitioner nor the petitioner has been put on T.I.P till date. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 29.01.2018. Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused person has been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Akorhigola P.S. Case No. 09 of 2016.
