JUSTICE ARUN KUMAR ORAL ORDER 18-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 30.1.2018, seeks bail in Chandan PS Case No. 46 of 2015 registered under Section 364 of the IPC.

It is a case of kidnapping for extortion against unknown. Learned Counsel for the petitioner submits that the mobile mentioned in the FIR, from which demand of ransom was made, do not belong to the petitioner rather it belongs to one Ashok Yadav and only material transpired against the petitioner is disclosure of his name for involvement in the occurrence made in his confessional statement, same day the so called victim had returned back, the petitioner was not put on TIP; Ashok Yadav was granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 131 of 2016. Having considered the said facts and circumstances, the petitioner, namely, Bihari Yadav @ Binod Yadav @ Binod Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Banka in connection with Chandan PS Case No. 46 of 2015.
