BAJANTHRI) Date : 21-03-2024 The present M.J.C. / Contempt petition is filed for non-compliance of order dated 13.09.2021 passed in C.W.J.C. No. 15396 of 2021.
2. Limited direction is asking the petitioner to submit representation within a period of four weeks from 13.09.2021. Petitioner is stated to have submitted representation on 06.10.2021, whereas the respondents have passed order on
Patna High Court MJC No.2257 of 2022 dt.21-03-2024 2/2 16.03.2024. There is a enormous delay in complying the orders of this Court. There is no application or review petition insofar as seeking extension of time in the order dated 13.09.2021 insofar as compliance within a period of three months. It is to be noted that three months have elapsed as on 05.01.2022. The respondents have taken two years and few days in complying the orders of this Court.
3. Having regard to the compliance, it is not appropriate to initiate Contempt of Court proceedings. On the other hand, petitioner is entitled to litigation cost. Litigation cost is quantified at Rs. 10,000/- (Rs. Ten Thousand). Cost shall be paid to the petitioner within a period of eight weeks from the date of receipt of this order.
4. Accordingly, the present M.J.C/Contempt petition stands dropped, reserving liberty to the petitioner to assail the order dated 16.03.2024 (Annexure-E) to Supplementary Show Cause filed on behalf of the respondent.
