The petitioner is seeking regular bail in Baheri P.S. Case No. 145 of 2011 registered under Sections 328, 302, 34 of the Indian Penal Code.
It is submitted that the allegation against the petitioner is that he and his brother both had illicit relationship with Rabina Devi, the daughter-in-law of the informant, and for that reason said Rabina Devi was not residing in the house of the informant. It is alleged that the son of this informant went to his Sasural where his wife and the co-accused conspired to kill him by administering poison. Learned counsel submits that prior to lodging of this case one UD case was lodged by the wife Rabina Devi and said Rabina Devi has been granted privilege of anticipatory bail by a co-
Patna High Court Cr.Misc. No.179 of 2018 (2) dt.12-01-2018 2/2 ordinate bench of this Court in Cr. Misc. No. 52747/2017. The allegations are baseless.
Considering the facts and circumstances of the case, let the petitioner, named above, be released on bail on his furnishing bail bond of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IX, Darbhanga, District Darbhanga in connection with Baheri P.S. Case No. 145 of 2011, subject to the conditions as laid down under Section 437(3) Cr.P.C.
