The petitioner has preferred this application for grant of regular bail in connection with Garkha P.S. Case No. 545 of 2022 dated 22.08.2022 registered for the offences punishable under sections 399, 402, 412, 413 and 414 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act. As per the prosecution case, the allegation against the petitioner and co-accused persons is of keeping stolen tractor in Galimapur Chawar. On seeing the police, they started fleeing away but two miscreants were apprehended by the police and

No.73538 of 2022(2) dt.06-04-2023 2/3 they disclosed their names as the petitioner, Chandarma Manjhi and the co-accused Satyendra Ray and they also disclosed the name of the person who fled away as Krishna Ray. It is further alleged that the petitioner and co-accused persons gathered there to commit dacoity.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The other co-accused person has already been granted bail by the Co-ordinate Bench vide order dated 24.02.2023 passed in Cr. Misc. No. 67089 of 2022. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.08.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran at Chapra in connection with Garkha P.S. Case No. 545 of 2022.
