Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 504, 506, 427, 325, 354, 307 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has antecedent of one case and has been falsely implicated in the instant case by the informant. It is next submitted that Nitish Kumar had approached this court seeking anticipatory bail by filing Cr. Misc No. 60293 of 2024 and the same was allowed by an order dated 23-8-2024 with a condition that the learned trial court before accepting the bail bonds of the petitioner (Nitish Kumar) shall verify the injury of the injured and in the event if it is found that injured suffered grievous

Patna High Court CR. MISC. No.68906 of 2024(2) dt.04-10-2024 2/2 injury on head, in that event, bail bonds of Nitish Kumar shall not be accepted.

Learned counsel next submits that bail bonds of Nitish Kumar has been accepted which amply demonstrates that the injury suffered by the injured is simple in nature. It is next submitted that petitioner is father of Nitish Kumar and he came to implicated only with a view of coerce Nitish into submission and petitioner is in custody since 5-6-2024.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Tankuppa P.S. Case No. 39 of 2024.
