Petitioner seeks bail in a case registered for the offences punishable under Sections 394, 395, 397, 411, 412 and 414 of the Indian Penal Code.

The FIR is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused Aman Tiwari. The looted bike was recovered from hut of Aman Tiwari and the petitioner was also there. The petitioner was identified during Test Identification Parade. Submission is that the petitioner is in custody since 16.08.2017. Charge sheet has already been submitted and the petitioner is ready to cooperate with the trial. Considering the aforesaid facts, I am not inclined

Patna High Court Cr.Misc. No.1386 of 2018 (3) dt.20-02-2018 2/2 to enlarge the petitioner on bail at this stage in connection with Dumraon Police Station Case No. 232 of 2017 pending in the court of learned Chief Judicial Magistrate, Buxar. Hence, prayer for bail is refused.

Learned trial court is directed to expedite and conclude the trial within a period of six months from the date of receipt/production of a copy of this order, failing which the petitioner would be at liberty to renew his prayer for bail. (Birendra Kumar, J) Kundan/- U T
