The petitioner seeks regular bail in connection with Garkha P.S. Case No.195 of 2024 registered for the offence under Sections 302/34 of the Indian Penal Code. 3.

The petitioner is accused of giving blow by a sword to the deceased. He is in custody since 15.04.2024. 4.

The injuries on the deceased are caused by hard blunt substance.

Learned counsel for the informant has vehemently opposed the bail application and has submitted that the petitioner has assaulted the deceased with the back side of the sword and therefore, the injuries have been caused by hard blunt substance.

Considered the submission of the parties.

If the informant would have alleged that the back side of the sword was used in the assault of the deceased then he would said the same in the F.I.R.

Considering the aforesaid facts, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - 4th, Saran at Chapra/concerned Court below in connection with Garkha P.S. Case No.195 of 2024, subject to the condition that he will cooperate in the trial and shall appear on the date fixed in the trial.
