JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Patepur PS case no. 34 of 2017 instituted for the offences punishable under Sections 302/34 of Indian Penal Code and section 27 of Arms Act.

The allegation is regarding the husband of the informant being working in a small shop and while he was returning from his shop, the accused persons are said to have shot him resulting in his subsequent death.

The learned counsel for the petitioner submits that all the witnesses who have been examined during course of

Patna High Court Cr.Misc. No.21808 of 2018 (6) dt.02-07-2018 2/2 investigation by the police, have stated that unknown criminals have killed the husband of the informant. Even the informant, in her further statement before the police, has stated that unknown persons have killed her husband and the petitioner has got no role to play in the said occurrence. The petitioner is said to be having a clean antecedent and he is in custody since 02.01.2018. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-Xth, Vaishali at Hajipur in connection with Patepur PS case no. 34 of 2017.
