The petitioner seeks bail in Parbatta (Maraiya) P.S. Case No. 390 of 2017 registered under Sections 447, 341, 323, 308 and 504/34 of the Indian Penal Code.
The petitioner is said to have assaulted on the head of the informant by means of iron rod over row of installation of hut on the land of the informant.
It is submitted by learned counsel for the petitioner that there is case and counter case between the parties. Co-accused Amarjeet Kumar has filed Parbatta P.S. Case No. 389 of 2017 against the informant regarding same date of occurrence earlier to the case under hand. Though the injury inflicted on the head of the informant is grievous in nature, but there is no repetition of blow.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Khagaria in connection with Parbatta (Maraiya) P.S.
