JUSTICE SANJAY KUMAR ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner, who is in custody since 05.02.2018, seeks bail in connection with Brahmpura P.S. Case No. 327/2017 registered for the offences punishable under sections 379/406/420 of the Indian Penal Code.

The case has been registered on the basis of complaint petition. The complainant happens to be owner of vehicle. It is alleged that this petitioner was working as the driver of complainant and has stealthily stolen the vehicle of complainant. It has been submitted that the petitioner, who was working as driver of the complainant, was driving the said vehicle and in course of service, some unknown persons snatched the said vehicle which was informed by the petitioner to the informant.

No.28681 of 2018 (3) dt.28-06-2018 2/2 Thereafter both of them visited at police station where Police did not register the case and thereafter the present case has been lodged. The petitioner has clean antecedent except a case registered under Excise Act in which he was allowed bail. Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Brahmpura P.S. Case No. 327/2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
