Petitioners are apprehending their arrest in connection with Kuchaikote PS Case No.138/19 , registered for offences punishable under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.

As per the FIR, allegation against the petitioner no.1 is of assault by rod on the head of the informant causing injury and against the petitioner no.2 of assault by lathi on the chick of the informant causing injury to him and the allegations are against the other accused persons also.

Submission of the learned counsel for the petitioners is

Patna High Court CR. MISC. No.61551 of 2019(2) dt.26-09-2019 2/2 that earlier to lodging of this case a case had been filed by the petitioners' side and this is a counter blast of the above case. Furthermore, the occurrence took place while the petitioners were putting window in their house and for that the occurrence took place. Opinion on the injuries has been kept reserved. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM VII, Gopalganj in connection with Kuchaikote P.S.Case no.138 of 2019 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
