The petitioner apprehends his arrest in connection with Awtarnagar @ Autarnagar P.S. Case No. 275 of 2020 for the offence registered under Sections 147, 148, 149, 341, 323, 324, 307 and 379 of the Indian Penal Code and Section 27 of the Arms Act.

From Annexure 1, it seems that the petitioner herein had earlier moved as petitioner no. 2 in Cr. Misc. No. 23757 of 2021, this was rejected by a reasoned order on 02.12.2021 by a Co-ordinate Bench of this Court.

From the order sheet, it is clear that the Co-ordinate Bench had applied its mind stating therein that the petitioner had

Patna High Court CR. MISC. No.69187 of 2022(2) dt.04-02-2023 2/2 knowledge that his act might cause death and Doctor had found the injury on the head and in that backdrop, his prayer was rejected.

Instead of taking recourse to bail by surrendering before the concerned Court, the petitioner-Raj Kumar Singh @ Raju Singh chose to once again preferred anticipatory bail, this Court does not find any merit in the second anticipatory bail after the rejection by the Co-ordinate Bench earlier. The petition accordingly stands rejected.

In view of the fact that the petitioner has misused the privilege of anticipatory bail, a cost of Rs. 5,000/- is imposed upon him to be paid to the Patna High Court Legal Services Committee within a period of four weeks.
