ANJANA MISHRA ORAL ORDER 11-05-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners have been in custody since 20.10.2017 in connection with Madhubani (Town) P.S. Case No. 315/2017 registered for the offences punishable under Section 379/411 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners were not named in the First Information Report, but were taken into custody on suspicion and, thereafter, they had been remanded in connection with several other cases also on the basis of their own confessional statement made before the police which has no evidentiary value. It is further submitted that the
Patna High Court Cr.Misc. No.22270 of 2018 (3) dt.11-05-2018 2/2 vehicle in question has not been recovered from their possession nor had they been placed on the T.I. Parade.
In view of the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani, in connection with Madhubani (Town) P.S. Case No. 315/2017.
