Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 25.4.2017 passed in Cr. Misc. No. 15276 of 2016 with a direction to the learned trial court to conclude the trial without a period of nine months and liberty has been given to the petitioner to renew his prayer for bail. Submission of the learned counsel for the petitioner is that there is no eye witness of the occurrence and the petitioner is in custody for 1 1⁄2 years and up-till-now the trial has not been concluded.

Having heard both sides and from perusal of the report it appears that up-till-now only one witness has been
Patna High Court Cr.Misc. No.19713 of 2018 (3) dt.02-05-2018 2/2 examined, as such let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Katihar in connection with Amdabad P.S.Case nO.120 of 2016 arising out of S.T.No.292/295 of 2017 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
