2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) and 32 of Bihar Prohibition and Excise Act.
3 . It is alleged that 732 liters of foreign liquor was recovered from the seized vehicle .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . The name of the petitioner transpired in the confessional statement of other coaccused persons. Petitioner is neither owner nor driver of seized vehicle . No incriminating material has been recovered from the conscious possession of petitioner and he is no way connected
Patna High Court CR. MISC. No.65246 of 2025(2) dt.09-12-2025 2/2 with the aforesaid recovery . Petitioner claims clean antecedent. 5 . Learned counsel for the State opposes the bail petition .
6. Considering the facts of the case , in the event of arrest/surrender within eight weeks from today , let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge IX Bhagalpur in connection with Bihpur (Jhandapur ) Police Station Case No. 549 of 2021, subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
