The petitioner, already in custody, seeks bail in connection with Lalganj P.S.Case No. 125 of 2017 registered under Sections 147,149,302,307,323,341,448 and 504 of the Indian penal Code.
Allegation in brief is that petitioner gave iron rod blow over the head of the informant's mother causing her death. Submission is that injury found on the person of the informant's mother is incised wound over the head so injury was not caused by hard blunt substance rather by sharp cutting object and the petitioner is in custody for one year. Whereas learned counsel for the State submits that sometime injury on the bony part caused by the hard blunt substance sometimes appears as incised wound and the accusation is specific against the petitioner.
Patna High Court Cr.Misc. No.28969 of 2018(5) dt.16-07-2018 2/2 Having considered the specific accusation against the petitioner, the Court is not inclined to grant bail to the petitioner. Accordingly, prayer of bail of the petitioner is rejected. However, trial court is directed to expedite the trial and conclude the same preferably within two years. (Arun Kumar, J) sujit/- U T
