The petitioner seeks regular bail in connection with Paroo P.S. Case No. 46 of 2018 for the offences punishable under Sections 147,148, 149, 307, 379, 427, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation is regarding 17 accused persons including the petitioner herein having fired and assaulted the informant and thereafter had stolen jewelry valued at a sum of Rs. 1 lac. The petitioner is stated to have fled away from the place of occurrence. The learned counsel for the petitioner submits that the petitioner has a fair antecedent, baring one case in which the petitioner is already on bail. Patna High Court Cr.Misc. No.26307 of 2018 (4) dt.28-05-2018 2/2 concerned, there is no specific allegation of having assaulted the informant. It is further submitted that the petitioner is languishing in custody since 7.3.2018.
The learned counsel for the informant has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-3rd, West, Muzaffarpur in connection with Paroo P.S.
