Petitioners are apprehending their arrest in Naubatpur P.S.Case No.323 of 2017 registered for the offences under Sections 406, 420, 354 and 506 of I.P.C.

Allegation against the petitioner, as per the complaint petition, is of taking Rs.2/- lacs from the complainant in the guise of searching her husband and in spite of that he did not search her husband and misbehaved with the complainant.

Submission of the learned counsel for the petitioner is that earlier the informant had filed a case bearing Vikram P.S.Case No.15 of 2017 under Section 498(A) of I.P.C. and 3⁄4 of D.P.Act against her husband including the petitioner. Further she had filed

Patna High Court Cr.Misc. No.3848 of 2018 (2) dt.01-02-2018 2/2 a petition before the S.D.J.M., Danapur stating therein that her ornaments worth Rs.2/- lacs has been taken away by the petitioner. As such, she is in the habit of filing such type of cases. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-II, Danapur, in Naubatpur P.S. Case No.323 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court.
