The petitioner seeks regular bail in connection with Khaira P.S. Case No. 26 of 2017 for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 181, 302, 427 of the Indian Penal Code.
The allegation against the accused persons is regarding assaulting the son of the informant and throwing him near Kiul River which resulted in his death subsequently during the course of his treatment.
The learned counsel for the petitioner submits that the co-accused persons have already been granted bail on the ground that though the charges have been framed, however, not even a single witness has been examined. The said order is dated
Patna High Court Cr.Misc. No.19843 of 2018 (3) dt.28-06-2018 2/2 15.11.2017 passed in Crl. Misc. No.53176 of 2017. The learned counsel for the petitioner has submitted that another co-accused has been granted on bail on 20.09.2017 by an order passed in Crl. Misc. No.36135 of 2017.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui or Successor Court in connection with Khaira P.S. Case No. 26 of 2017.
It is further directed that the petitioner shall mark his attendance before the concerned Police station on every Monday of the week at 10 A.M. and co-operate in the investigation. His failure to mark attendance before the concerned police station on two consecutive dates would render the present order void. (Mohit Kumar Shah, J) BTiwary/- U T
