2. The petitioner apprehends his arrest in connection with Pratapganj P.S. Case No. 112 of 2017 registered for offence punishable under section 379 of the Indian Penal Code.

3. The prosecution case in short is that the accused persons stolen away laptops, mobile, gold ornaments and Rs.42,000/- cash of the informant from his house.

4. The learned counsel for the petitioner has submitted that nothing was recovered from the possession of the petitioner and the material emerged against him during the course of investigation is only the confessional statement of co-accused. He has been made accused on the basis of his criminal

Patna High Court CR. MISC. No.69893 of 2023(2) dt.01-11-2023 2/2 antecedent disclosed in paragraph 3 of the bail petition and in all the cases, he is on bail except the case mentioned, as serial no.4, in paragraph no. 3 of the bail petition.

5. On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur, Supaul in connection with Pratapganj P.S. Case No. 112 of 2017, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) Mahesh/- U T
