The petitioner apprehends his arrest in Complaint Case No.362C/2016 registered under Sections 406, 420/34 of the Indian Penal Code.
The complainant alleged that the petitioner executed an agreement to hire the vehicles bearing No. BR-19F-2360 and BR50P-13762360-BR 1376 for use of the students on payment of Rs.21,000/-. The complainant further stated that the petitioner paid Rs.21,000/- for the month of April, 2015 but the petitioner did not pay the amount of hired vehicle from the month of May, 2015.
The learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.283 of 2018 (2) dt.15-01-2018 2/2 petitioner only paid the vehicle of the complainant for one month and thereafter he became ill. Therefore, he did not use the vehicles of the complainant.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with in Complaint Case No.362C/2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
