1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial no. 412 of 2023 arising out of Musrighrari P.S. Case No. 26 of 2022, registered under sections 302 and 34 of the Indian Penal Code.

3. As per prosecution case, the informant states that this petitioner using the mobile number of co-accused Raj Kumar called her husband and thereafter he did not return the said night. On the next day his dead body was discovered in the agricultural land. She states that Bablu Singh, Ravi Ranjan Kumar and Bansi Prasad Sigh had threatened him on an earlier occasion.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.69296 of 2023(3) dt.20-12-2023 2/2 petitioner has been falsely implicated in the case. There is no eye witness to the occurrence. The case against the petitioner is not even of last seen. Co-accused Raj Kumar has been enlarged on bail vide order dated 4.7.2023 passed in Cr. Misc. no. 2937 of 2023. The petitioner is in custody since 25.1.2023 and charge-sheet has been submitted.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, grant of bail to co-accused Raj Kumar by the above order, the petitioner being in custody since 25.1.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no. 412 of 2023 arising out of Musrighrari P.S. Case No. 26 of 2022, on furnishing bail bond of Rs. 10,000- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Samastipur.
