The petitioner seeks regular bail in connection with Patliputra P.S. Case No. 318 of 2013 (G.R. No. 5504 of 2013) for the offences punishable under Sections 420, 467, 468, 471, 120B, 34 of the Indian Penal Code and Section 25(1-b)a, 26, 27, 30, 35 of the Arms Act.

The allegation in the present case is that when the gun license of the security guards of CMS Agency was verified, it was found that licence was issued in favour of the petitioner from a place where the petitioner had never resided, hence it was suspected that the petitioner was carrying a fake license. The learned counsel for the petitioner submits that the petitioner has never misused the gun and the petitioner is

Patna High Court Cr.Misc. No.20197 of 2018 (4) dt.28-06-2018 2/2 having a genuine licensee. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 16.12.2017. It is further submitted that similarly situated coaccused persons have already been granted bail vide order dated 05.6.2014 passed in Crl. Misc. No.13903 of 2014 and order dated 30.06.2014 passed in Crl. Misc. No.20688 of 2014. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 12th Additional Chief Judicial Magistrate at Patna in connection with Patliputra P.S.
