Petitioner is an accused in a case registered for offence under sections 364, 34 IPC.

Learned counsel for the petitioner submits that on 14.1.2017 when the petitioner's wife went missing he had lodged a complaint (Annexure 2). Mother of the victim and one of her brothers were signatories to the said complaint. Thereafter, the petitioner had taken adequate steps to ensure her recovery by making communication to the SSP, Dhanbad. On 16.2.2017 other steps such as publishing notice of missing person was done. 11 months thereafter FIR was lodged by another brother of the victim implicating the petitioner in the case.

Learned counsel for the petitioner submits that the

No.24708 of 2018 (3) dt.24-05-2018 2/2 petitioner has falsely been implicated in this case, after unexplained delay of 11 months, in respect of the occurrence for which the petitioner along with his in-laws had also lodged a case in the police station. Prior to lodging of this case, petitioner is a man of clean antecedent. Petitioner is in custody in connection with this case since 29.11.2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. NK Yadav, Judicial Magistrate 1st class, Jamui in Chandradeep Police Station Case No. 114 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
