Mr.Anuj Kumar Shrivastava, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 17-12-2025 Heard Mr. Sanjay Kumar Sinha, learned counsel for the petitioner and Mr. Anuj Kumar Shrivastava, learned APP for the State.

2. Petitioner seeks regular bail in connection with Begusarai Town P.S. Case No. 222/ 2025 dated 02.06.2025 registered for the offence(s) punishable under Section(s) 25(1B)(a) and 26 of the Arms Act.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is engaged in the real estate business and when the illegal demand made by the informant was not fulfilled, the FIR in the present matter was fabricated and the recovery of the alleged firearms was not made in the presence of independent witnesses and the said recovery is claimed to have been made only in presence of police personnel

No.64364 of 2025(3) dt.17-12-2025 2/3 and after submission of the charge sheet, learned Magistrate took cognizance in the absence of requisite prosecution sanction, thereafter, the petitioner challenged the cognizance order by filing Cr. Revision No. 248 of 2025 which was allowed and the cognizance order was set aside and accordingly, at the present time, the petitioner's detention is completely illegal in the present matter. It is further submitted that though against the petitioner there are criminal antecedents of six cases, in one case he has been wrongly named and in this regard, paragraph 46 of the case diary may be perused and in other four cases, the petitioner is already on bail. It is lastly submitted that the petitioner has been languishing in jail since 03.06.2025 in the present matter.

4. Learned APP appearing for the State has vehemently opposed the bail prayer of the petitioner .

In the facts and circumstances of this case as well as considering the aforesaid submissions advanced by the petitioner's counsel and mainly taking into account the setting aside of the cognizance order against the petitioner by the learned Principal Sessions Judge, Begusarai as stated above, this court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail in connection

Patna High Court CR. MISC. No.64364 of 2025(3) dt.17-12-2025 3/3 with Begusarai Town P.S. Case No. 222/ 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
