The petitioner has prayed for bail in a case registered for the offence punishable under sections 394, 302/34 of the Indian Penal Code and section 27 of the Arms Act. Prosecution case relates to broad day light robbery and murder of Ayesh motors dealer cashier Rajat Pratik by the accused persons including the petitioner. It is further alleged that they have looted Rs. 6,66,140/-.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case. He is innocent. Nothing has been recovered from his conscious possession. Petitioner is not named in the F.I.R. There is no eye witness of the present occurrence. Save and except suspicion, no

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Katihar in connection with Muffasil P.S. Case No. 82 of 2022.
