====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-03-2025 Heard learned counsel for the petitioner, the State and opposite party no.2.

2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 468 & 471 and other allied sections of the Indian Penal Code.

3. As per the prosecution case, complainant was in need of money and wanted to sell one katha land. On getting this information, petitioner contacted complainant who agreed to sell the land on payment of Rs.25 lacs and to this effect agreement was signed between the parties. Thereafter, petitioner gave Rs.12.40 lacs to the complainant but he did not give the remaining amount to complainant rather he put false signature of complainant and changed the rate of land from Rs.25 lacs to Rs.17.50 lacs on the original agreement.

It is submitted on behalf of the petitioner that the complainant is already involved in series of litigation with his agnates with respect to the land in question in the BLT, Patna as well as in the DCLR Court, Patna. Complainant has himself manipulated the sale agreement to harass and humiliate the

Patna High Court CR. MISC. No.80730 of 2024(3) dt.18-03-2025 2/2 petitioner. Dispute is purely of civil nature and no criminal offence is attracted against the petitioner. Petitioner has got no criminal antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III, Patna in Complaint Case No. 2937C/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
