JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was twice rejected directing the trial court to expedite the trial of the petitioner and the impugned order goes to show that case is pending for recording the defence evidence. Therefore, it is obvious from the aforesaid fact that trial of the petitioner is on the verge of conclusion.

Accordingly, the prayer for bail of the petitioner in

Patna High Court Cr.Misc. No.2967 of 2018 (2) dt.17-01-2018 2/2 connection with Sessions Trial No. 455 of 2015 arising out of Madhuban P.S. Case No. 69 of 2014 pending in the court of learned trial court (F.T.C.-1), Motihari stands rejected. However, learned trial court must expedite the trial of the petitioner and try to dispose of the same within two months from the date of receipt/production of copy of this order at any cost.
