Learned counsel for the informant is also present. The petitioner is in custody since 08.12.2017 in connection with Laxmipur P.S. Case No. 62 of 2017 for the offence registered under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is allegation that the petitioner had attacked the informant with an axe, there was a dispute between the parties regarding some payment to be made to the father of the present petitioner, and therefore, the said occurrence has taken place. It is further submitted that though the injuries have been attributed to the petitioner, he has already been in custody for five months and as such, he may be released on bail and that he is willing to abide by the terms and conditions imposed by this court, if directed to be

Learned counsel for the informant however, submits that the injuries were grievous in nature.

Considering the aforesaid facts and circumstances of the case and that the petitioner has already been in custody for five months, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., 3rd, Jamui in connection with Laxmipur P.S.
