Petitioner seeks bail in connection with Tarabari P.S. Case No. 09 of 2016 a case registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

The petitioner was Principal of the school of which construction was not completed by the petitioner and public money was withdrawn.

Learned counsel for the petitioner had submitted on the last occasion that after lodging of the FIR, the petitioner has already completed the work and thereafter the informant was directed to personally verify the work completion matter and

The informant is physically present. Complying the order dated 19.04.2018, show cause vide Annexure-13 has been filed, from which it would reveal that the work had already been completed. Annexure-13 is supported by the report of the Engineers involving in the construction work. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Tarabari Police Station Case No. 09 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
