The petitioner, already in custody, seeks bail in connection with Bettiah Town P.S.Case No. 776 of 2013 registered under Sections 307, 333, 353, 387/34 of the Indian penal Code and 27 of the Arms Act.
Allegation in brief is that two persons came at the house of the informant and fired at him which hit on the wall and thereafter a call came disclosing the name of the petitioner that he had got this occurrence done as he refused to manage tender in his favour.
Submission is that it is not alleged that petitioner had fired at the informant and no one was injured and in the case diary it is also not ascertained from whose mobile call was made to the mobile of the informant. It is also submitted that petitioner had not tendered for contract in the informant's
Patna High Court Cr.Misc. No.6505 of 2018(5) dt.18-05-2018 2/2 department.
Learned counsel for the State also does not point out that whether any call on the mobile of the informant was made from the mobile of this petitioner, however it is pointed out that petitioner has several criminal antecedents.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Sameer Ansari, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah (West Champaran) in connection with Bettiah Town P.S. Case No. 776 of 2013.
