1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 80(2), 238 and 3(5) of the BNS, 2023.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that his daughter was married to the son of the petitioners and out of the wedlock, a child was born, further the accused persons started demanding a motorcycle and on account of non-fulfillment of the demand, his daughter was killed and the body disappeared.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case being the father-in-law and the mother-in-law of the deceased. It is next submitted that informant is not an eye witness to the occurrence. It is also submitted that no doubt allegation of demand of dowry and torture is alleged, but then allegation of torture is general and omnibus in nature. It is next submitted that whenever any dispute arises in between the husband and the wife and the occurrence of the nature as alleged takes place, the entire family members are implicated in a mechanical manner with general and omnibus allegations.

Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioners and submits that from perusal of the allegation as alleged in the FIR, it would manifest that the dead body of the victim was not found, which amply demonstrates that the body was cremated or disposed of. It is next submitted that had the petitioners not been involved in the occurrence, in that event efforts would have been made to ensure that the body is sent for postmortem so that the cause of death is ascertained, but since the body was not found, which amply demonstrates about the involvement of the petitioners in the occurrence. It is also submitted that it is not

6. Considering the submissions made by the learned APP for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.
7. Accordingly, the instant anticipatory bail application stands rejected.
