The petitioner seeks bail in connection with Warsaliganj P.S. Case No.203 of 2016, instituted for the offence under Sections 364, 365/34 of the Indian Penal Code. It is submitted from the allegations made in the FIR itself that it is apparent that the victim husband of the informant had gone with the petitioner and two other co-accused Janki Paswan and Roopchand Paswan. The motive has been attributed on account of loan being taken by Janki Paswan. The co-accused Janki Paswan has been allowed bail in Cr. Misc. No.32331 of 2018 (Annexure-2). The petitioner as per the statement made in the petition has no criminal antecedent and he

Learned APP for the State opposed the prayer for bail. Having considered the rival submissions of the parties, prayer for bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Nawada, in connection with Warsaliganj P.S. Case No.203 of 2016, subject to the following conditions :- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court, if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
