JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 7.11.2017, seeks bail in Bhagwanpur (Teyay O.P.) PS Case No. 146 of 2015 registered under Section 302/34 of the IPC and Section 27 of the Arms Act. The allegation in brief is that the informant's son of was shot dead by unknown miscreants near the grave yard of the village.

It is contended that the petitioner's name transpired after two years of the occurrence, during investigation conclusion is that Amresh Choudhary and his brother Lootan Choudhary have eliminated the deceased and they were found near the bathan of the petitioner, the petitioner has no criminal antecedent except one case lodged against him in the year 2010 in which he is on bail. Having considered the said facts and circumstances, the petitioner, namely, Mukesh Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Begusarai in connection with Bhagwanpur (Teyay O.P.) PS Case No. 146 of 2015.
