JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Ramnagar P.S. Case No. 115 of 2019 registered for the offences punishable under Sections 147, 149, 323, 307, 384 and 504 of the Indian Penal Code.

There is allegation against petitioner No.2 is that he assaulted the informant by means of 'Bakka', causing injuries on his head and neck and there is also allegation one accused Anita Dei of pulling his testicle of the informant, due to which

Submission of learned counsel for the petitioners is that a title suit is going on between the parties and from petitioners' side a complaint case has been lodged against the informant and others and moreover the injuries are simple in nature, which will appear from Annexure-2.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bagaha, West Champaran, in connection with Ramnagar P.S. Case No. 115 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
