JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-09-2019 It is the petitioner's case that he retired as Revenue Karmchari from the Anchal Office, Navinagar with effect from 31.03.2011. He was entitled for grant of 2nd ACP and MACP in pursuance of the decision of the State Government, which has so far not been extended to him. It is his further case that he had approached the District Magistrate by filing representations in 2015 and 2018, copies of which have been brought on record by way of Annexures-2 and 3 to the writ application.
2. There is no acknowledgment of any official of receipt of the petitioner's representations, as can be easily seen from the said Annexures-2 and 3. There is no explanation why
Patna High Court CWJC No.18921 of 2019(2) dt.26-09-2019 2/2 the petitioner has approached this Court more than eight years after his superannuation for grant of benefits as being claimed by him.
3. I am therefore, not inclined to grant the petitioner benefit, which he is seeking. However, refusal by this Court to entertain belated claim of the petitioner shall not come in way of the petitioner approaching the authorities by making a representation claiming his entitlement of grant of Assured Career Progression.
