The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner is that he assaulted the informant by means of iron rod and snatched Rs. 70,000/- from the pocket of informant.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Injury report does not corroborate with the prosecution version. From perusal of

Patna High Court CR. MISC. No.64534 of 2022(2) dt.24-02-2023 2/2 the injury report, it appears that only one injury is sustained by the informant while the allegation is of assaulting by 3 persons. There is an inordinate delay of 4 days in lodging the F.I.R. It is also submitted that petitioner is languishing in judicial custody since 23.08.2022.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Baruraj P.S. Case No. 64 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur(West).
