JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Harnaut (Kalyan Bigha) P. S. Case No. 339 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. there is recovery of 17 liters of county made liquor from the open field and the name of the petitioner was disclosed by one co-accused Chanchal Manjhi that he supplying the liquor.

Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, in view of the facts, as stated above, this application is disposed of with a direction to the learned Special Judge Excise to verify the above submissions

Patna High Court CR. MISC. No.60253 of 2019(2) dt.24-09-2019 2/2 and, if petitioner has no criminal antecedent and there is nothing against the petitioner, except the confessional statement of the co-accused, he will release the petitioner on bail to his own satisfaction.
