2. The petitioner seeks regular bail in connection with Naugachia P.S. Case No. 184 of 2023 dated 07.06.2023, lodged under Sections 302 and 34 of the I.P.C. read with Section 27 of the Arms Act.

3. As per the prosecution case, the F.I.R. has been lodged against two named accused persons, one of them is Atal Kumar, who is the main assailant of the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that there is no allegation against the petitioner. He further submits that the petitioner is in custody since 08.06.2023.

5. Learned A.P.P. for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case, this bail application is allowed.

7. Let the petitioner above named, be granted bail only after framing of charge on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachia in connection with Naugachia P.S. Case No. 184 of 2023.
