JUSTICE ARUN KUMAR ORAL ORDER 11-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.1.2018 seeks bail in Turkaulia (R) PS Case No. 16 of 2018 registered under Sections 457 and 380 of the IPC.

The allegation in brief is that in the mid-night theft was committed in the house of the informant, cash and some jewelry were stolen and it is alleged that the informant's daughter identified the petitioner who lives in the neighbour hood. Learned Counsel for the petitioner submits that neither any looted money or jewelry have been recovered from the possession of the petitioner and merely on suspicion his name was disclosed by the informant's daughter, no one made any effort to apprehend him at that time and he is in custody since 9.1.2018. Having considered the said facts and circumstances, the petitioner, namely, Dhiraj Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Motihari in connection with Turkaulia (R) PS Case No. 16 of 2018.
