====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 21-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Gurua P.S. Case No. 168 of 2024 dated 22.05.2024 registered for the offences punishable under Sections 304B, 201/34 of the I.P.C. and Sections 3⁄4 of the D.P. Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have committed murder of the informant's daughter due to non-fulfilment of demand of Rs. 2,00,000/- as dowry.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner neither demanded

The petitioner is neither the family member or relative of the informant or deceased's husband as stated in paragraph no. 6 of the bail petition. He is only the co-villager as well as the Mukhiya of the village and due to village rivarly his name has been implicated in the present case. He has no concern with the alleged offence. He is separate in mess and property from the husband of the deceased. Nothing has been recovered from the possession of the petitioner. It is submitted that the other co-accused persons, namely, Rambriksh Prasad and Chhotu Kumar @ Pramanand Kumar who are father-in-law and brother-in-law of the deceased have already been granted bail by a Bench of this Court vide Cr. Misc. No. 60808 of 2024 under order dated 04.09.2024. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 21.07.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Sherghati, Gaya in

Patna High Court CR. MISC. No.68774 of 2024(2) dt.21-09-2024 3/3 connection with Gurua P.S. Case No. 168 of 2024.

7. The application stands allowed.
