2. The petitioner seeks regular bail in connection with Sessions Trial No.527 of 2011 arising out of Sasaram (M) P.S. Case No. 995 of 2009 dated 14.12.2009, lodged under Sections 147, 148, 149, 341, 323, 324, 307, 353, 333 of the Indian Penal Code read with section 27 of the Arms Act.

3. Learned Counsel for the petitioner submits that the petitioner was granted bail but due to non-appearance, his bail bond was cancelled and he has not opted to prefer appeal against cancellation. Instead thereof, petitioner has prayed for fresh bail which was rejected by the Trial Court and thereafter, he has moved before this Hon'ble Court. Counsel further submits that the bail bond of the petitioner was cancelled on 08.03.2019 and case was transferred to the Trial Court in the year 2020. Counsel submits that the petitioner is ready to appear physically on each and every date and he shall support in the trial. Counsel further submits that the criminal antecedent of the petitioner is clean and he is in custody since 19.08.2024.

4. Learned APP for the State opposes the prayer for bail of the petitioner and submits that in the rejection order, the trial which is of 13 years old, could not be concluded.

In this view of the matter, let the petitioner above named be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of A.D.J.-V, Rohtas at Sasaram in connection with Sessions Trial No.527 of 2011 arising out of Sasaram (M) P.S. Case No. 995 of 2009, subject to the conditions as laid down U/s 437(3) Cr.P.C.

6. It is made clear that the petitioner has been granted bail on condition that he shall appear on each and every date before the Trial Court and failure to appear on two consecutive dates shall be resulted into cancellation of his bail bond. (Dr. Anshuman, J) Divyansh/- U T
