Diary of the present case was called for which has since been received.

The petitioner has been in custody since 16.11.2017 in connection with Nasirganj (Rajpur) P.S. Case No. 241 of 2017 for the offence registered under Sections 307, 341, 323, 379 and 324/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the allegation against the petitioner is of attack with a knife, the medical report entirely belies the prosecution story as the injury purported to have been inflicted has been found to be by a hard blunt substance. He, thus, submits that such an injury report cast serious cloud on the prosecution story.

Considering the aforesaid facts and circumstances of the case and that there is no cogent material in the case diary to

No.280 of 2018 (3) dt.17-02-2018 implicate the petitioner in connection with the present case and also because the petitioner has clean antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Vikramganj, District Rohtas in connection with Nasirganj (Rajpur) P.S. Case No. 241 of 2017.
