The petitioner has prayed for regular bail in a case registered for the offence punishable under section 304(B), 201 and 34 of the Indian Penal Code.

As per prosecution case, informant alleged that her sister had married with one Amod Shahni, after sometime, her sister was tortured and assaulted by the petitioner as well as coaccused persons. It is further alleged that informant's sister has been murdered due to non-fulfillment of dowry demand thereafter her dead body has also been cremated. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is mother-in-law of deceased due to which she has

The petitioner has no concern mess and business of the deceased as well as her husband and was also living separately them. The main responsibility upon the husband of the deceased to maintain with dignity and honour who is already in judicial custody. She has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 13.06.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kudhani P.S. Case No. 92 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Muzaffarpur, (West).
